Olivia Wilde Claims Ex Jason Sudeikis Meant to ‘Embarrass’ Her with Custody Papers Served Onstage: Report

Olivia Wilde has legally filed to dismiss ex Jason Sudeikis’ custody request for which she received paperwork at CinemaCon in April – and claims the delivery method was “aggressive”.

In recent court documents obtained by the Daily Mailthe actress and director, 38, accused Sudeikis, 46, of ‘professionally embarrassing me’ when she was served the papers during a presentation she was giving on stage at the event in Las Vegas .

“Jason’s actions were clearly intended to threaten and catch me off guard. He could have served me quietly, but instead chose to serve me in the most aggressive manner possible,” Wilde said in his court filing, per DM.

“For Jason to embarrass me professionally and expose our personal conflict in this way is extremely contrary to the best interests of our children,” added the star, who shares daughter Daisy, 5, and son Otis, 8. years, with her former fiancé.

“Since Jason has made it clear that we will not be able to resolve this issue for the sake of our children outside of the court system, I have filed for custody in Los Angeles,” Wilde said.

Sudeikis reiterated in his own filing, reports DMthat he did not intend for Wilde to receive the papers on stage at CinemaCon, but instead requested that they be served at Heathrow Airport – and that plans to serve them at the hotel where she was staying for CinemaCon in Las Vegas went wrong.

“I understand that the bailiff had only done his job, but I deeply regret what happened,” said the Ted Lasso star. “Olivia’s conference was a significant event for Olivia, both professionally and personally, and I’m really, really sorry that the incident ruined her special moment.”

He also explained of Wilde, who is currently dating Harry Styles, “I didn’t want the service to be at Olivia’s current partner’s home because Otis and Daisy might be in attendance.”

“I didn’t want the service to take place at the children’s school because the parents might be present,” Sudeikis also said, according to DM.

According to court documents obtained by PEOPLE on Wednesday, the judge sided with Wilde, granting his motion to dismiss custody applications filed by Sudeikis in October since “this court finds that New York does not have jurisdiction to hear the custody applications because New York is not the home state of the subject children.” The case will remain in California.

While many believed at the time that the envelope given to Wilde was an unsolicited script, sources have previously confirmed to PEOPLE that the don’t worry darling The director was served legal documents regarding her children with Sudeikis mid-presentation.

An industry source told PEOPLE that Wilde “was surprised and embarrassed” when she was served the newspapers on stage, “but she moved on quietly.”

A source close to Sudeikis, meanwhile, told PEOPLE: “Documents have been drawn up to establish jurisdiction over the children of Ms. Wilde and Mr. Sudeikis.”

“Mr. Sudeikis had no prior knowledge of when or where the envelope would have been delivered, as that would depend only on the processing service company involved and he would never tolerate it being served as such an inappropriate way,” the latter source said. added.
